How long does a landlord have to return the deposit?

Within 10 days of both sides agreeing how much goes back, according to GOV.UK.

By Charles Worth · Last checked 29 October 2026

GOV.UK says the deposit must be returned within 10 days of both the landlord and the tenant agreeing how much goes back. The clock starts when the amount is agreed, not when the tenancy ends.

What the 10 days means

GOV.UK does not say whether these are calendar days or working days. The deposit deadline calculator counts calendar days, which is the cautious reading. Returning the money earlier does no harm.

If the landlord and tenant disagree

GOV.UK says the deposit stays protected in the scheme until the issue is settled. With an insured scheme, the landlord or agent has to hand the deposit to the scheme, which holds it until then. Each scheme has its own dispute process, so check the scheme's website.

Which schemes hold deposits

The three approved schemes in England are the Deposit Protection Service, MyDeposits and the Tenancy Deposit Scheme. Each offers a custodial option, where the scheme holds the money, or an insured option, where the landlord or agent holds it.

Can the landlord make deductions?

That depends on what is agreed or decided in a dispute. For example, GOV.UK's guide to the Renters' Rights Act says a deposit can cover pet damage (see pets and the new rules). This site does not cover what counts as a fair deduction.

Where the deposit was never protected

Different rules apply. See what a tenant can claim if the deposit was not protected.
