How much rent in advance can a landlord ask for?
Up to one month's rent after signing and before the tenancy starts, in England from 1 May 2026.
From 1 May 2026 there is a limit on rent in advance in England. GOV.UK says landlords and agents cannot require or accept rent in advance before a tenancy is agreed. After the agreement is signed and before the tenancy starts, they can ask for up to one month's rent (28 days for tenancies shorter than a month).
What the Act says
The Renters' Rights Act 2025 inserts section 4B into the Housing Act 1988. A term that requires rent to be paid in advance has no effect. The Act itself states no figure, so the one-month limit comes from the GOV.UK guide, which NRLA and Shelter also describe.
What if a tenant wants to pay early?
GOV.UK says tenants may still choose to pay early. The rule stops landlords from requiring it, so an agreement term that demands several months up front cannot be enforced.
Penalties
GOV.UK gives civil penalties of up to £5,000 and repayment orders for breaches. The rule applies in England only.
This is separate from the deposit cap
A deposit is capped at five weeks of rent (six if annual rent is £50,000 or more), and a holding deposit at one week. Both limits apply together. Work out the deposit with the deposit cap calculator, and see the deposit rules guide for protection and return.
